Terms and Conditions
1. Nature of the Booking, Confirmation & Contract Formation
1.1. A booking request submitted through our website or booking form is not a confirmed reservation.
1.2. The reservation becomes valid only once you receive a written confirmation from us and the corresponding contract has been signed by both parties (electronically or physically).
1.3. Until the contract is duly signed by both the guest and the property, we may decline, modify, or cancel the booking request without liability.
1.4. Once signed, the contract prevails over these website Terms & Conditions and becomes the legally binding document governing the stay.
2. Legal Nature of the Stay
2.1. Rooms and private suites are governed by a civil contract of use and services (“arrendamiento de habitación”), outside the scope of the Housing Tenancy Act (LAU).
2.2. Full-unit apartments are offered as seasonal rentals (arrendamiento de temporada), which legally require a specific reason for the stay (work, study, relocation, etc.).
For the avoidance of doubt, these stays do not confer permanent residency rights and always operate with fixed start and end dates established in the signed contract.
3. Usage Conditions
3.1. All residents must comply with:
• General usage conditions,
• House Rules,
• Community Guidelines for shared spaces.
3.2. Violations may result in contract termination without refund.
3.3. Security deposits may apply and can be used for damages or excessive cleaning.
4. Check-In Requirements
4.1. Valid ID must be provided for mandatory police registration.
4.2. For seasonal rentals, the declared purpose of the stay must be submitted before check-in.
4.3. Access may be denied if required documentation is missing.
5. Payment Terms
5.1. Payment schedules will be set out in the signed contract.
5.2. Non-payment may result in cancellation or refusal of check-in.
6. Cancellation Policy
6.1. General conditions
• Free cancellation up to 30 days before arrival.
• If cancellation is done < 30 days before check-in, the first month will be charged.
6.2. No-Show
• Considered a full cancellation; 100% of the stay is charged.
6.3. Date Changes
• Subject to availability.
• If the adjustment shortens the stay or shifts into different pricing periods, it may be treated as a cancellation.
7. Early Termination by the Property
Immediate termination (without refund) may occur e.g. in cases of:
• Disruptive or dangerous behavior,
• Rule violations,
• Illegal activities,
• Actions compromising safety or community standards.
• Any other reasons stipulated in the contract or by law
If termination is due to force majeure or property-related issues, proportional refunds apply.
8. Liability
We are not responsible for theft or damage to personal items. Guests use facilities at their own risk and are liable for damages caused by negligence or misuse.
9. Community Standards
This is a curated professional co-living. Harassment, discrimination, aggression, or pattern of disturbance leads to immediate contract termination.
10. Data Protection
Personal data is processed solely for contractual and legal compliance.
11. Governing Law
Spanish law (including Canary Islands regulations) applies. Courts of Santa Cruz de Tenerife have jurisdiction unless consumer protection laws mandate otherwise.
12. Contract Priority & Binding Effect
12.1. These Terms & Conditions outline general rules for the booking process.
12.2. The final signed contract between the resident and Tenerife Invest S.A. supersedes these Terms in case of conflict.
12.3. Once signed by both parties, the contract becomes fully binding, and all rights and obligations shall be interpreted strictly according to the contract’s clauses.
